Minutes of the December 1, 2008 Monthly Town Board MeetingChairman Schmidt called the meeting to order at 7:00 PM. Those attending were Chairman Schmidt, Supervisor Williams, Supervisor Osfar, Clerk Allis and Treasurer Sell. There were 18 people in the audience.Supervisor Osfar made a motion to approve the agenda at the discretion of the Chairman. Supervisor Williams seconded and the motion carried.Supervisor Williams made a motion to approve the minutes of the November 3, 2008 Monthly Town Board Meeting and the November 17, 2008 Budget Hearing, Special Town Meeting and Special Town Board Meeting. Supervisor Osfar seconded and the motion carried.Supervisor Osfar made a motion to accept the Treasurer’s report as read. Supervisor Williams seconded and the motion carried.Supervisor Osfar reported the Winchester Town Lakes Committee met November 20, 2008. They discussed purchasing t-shirts for volunteers at the boat landings; having a forum to discuss lake issues such as jet skis, lake pollution, promotion of non-phosphorous fertilizers, weeds, abandon piers, fireworks, etc. The WTLC meets the fourth Thursday of the month at 9:00 AM. Their next meeting will be in January. Supervisor Osfar spoke with Leo Crawley regarding the brusher parked on the snowmobile trail on Hwy O. The trail boss will contact Jim Fischer because the snowmobile trails will be opening December 16, 2008. Supervisor Williams reports Ginger at the Recycling Site would like a high speed connection at the site so she could do some of her ambulance work while she is there. The Library Board met November 24, 2008. They are joining WisCat which will let them borrow books from libraries all over the state. They will join for one year to try it out. The Library Board has made their recommendations for the new Library Board Members. The next Library Board Meeting will be December 29, 2008 at 6:30 PM. Supervisor Williams received a notice that Rebecca Nordine, Addressing Coordinator for Vilas County, will be taking over the addressing grid for Lt. Peske. Chairman Schmidt reports last month the town crew did plowing, sanding, maintenance of equipment at the transfer site, maintenance on some of the buildings and put up the Christmas lights. Next month, the town crew will be plowing. Bill Sell and Ginger Brousil requested the wall between the two offices in the ambulance bay be removed to make one large office, the town crew will remove the wall. Land purchase – we have the warranty papers and the deed in the office; the final loan papers are not back, we should be getting them soon. Chairman Schmidt spoke with Bill Sell regarding the rescue truck – they are still anticipating delivery of the truck the last week in December. They will be going to Marion for the final walk through of the truck. Correspondence – We did get the State School Credit and Lottery Credit, $200,202.80 combined and the First Dollar Credit, $12,055.59 (this is something new the state is doing). Taxes should be printed this week. Lt. Gary Peske from the Vilas County Sheriff’s Department and Barb Gibson and Rebecca Nordine from the Vilas County Mapping Department attended the board meeting to discuss with the Town Board the intent of the letter they sent regarding the implementation of the Vilas County Uniform Addressing System Ordinance. Barb Gibson sent the town a letter in August 2008 regarding its non-compliance of the Uniform Addressing System Ordinance. Three areas were mention as being non-compliant: address signs, road name signs and inconsistent addressing. The town has one year from receipt of the letter of non-compliance to provide the Land Information and Mapping Department with a plan of compliance, otherwise the town could face legal action. Barb Gibson stated the purpose of the letter was to provide official notice of non-compliance. The town has one year to provide a plan and ten years to complete the plan. The Town Board did not like the “tone” of the letter, they felt it threatening. Barb Gibson stated this was a form letter sent to all the towns in Vilas County. It was an informational letter, not a threatening letter. Vilas County needs to have accurate information when dispatching the 911 emergency services. The town has every intention of complying with the ordinance, but the supervisors thought the tone of the letter needed to be discussed. Discussion was held regarding speed limits on town roads. Supervisor Williams feels it is necessary to post 35 mph speed limits on town roads because the roads are used for transportation and exercise. With the roads not being posted, the current speed limit is 55 mph. Supervisor Williams feels there are very few roads that can be traveled safely at that speed. Supervisor Williams checked on the State Statutes and spoke with Attorney Lee Turonie, Assistant Legal Counsel for the Wisconsin Towns Association. We would need two ordinances to set speed limits: 1) a speed limit ordinance; 2) citation authority ordinance. Vilas County Sheriff’s Department would have to issue the citations. Chairman Schmidt stated we do have a town citation ordinance on file. Supervisor Williams read State Statute 346.57 (4)(j) stating 35 mph on any town road where on either side of the highway within any 1,000 feet along such highway the buildings in use for business, industrial or residential purposes fronting thereon average less than 150 feet. The town would have to adopt an ordinance and sign the roads. Supervisor Williams stated that having the roads posted for 35 mph would at least slow down most drivers and it would give them warning that the roads are not drivable at 55 mph. Supervisor Osfar made a motion to table any further discussion until the January 5, 2009 Monthly Town Board Meeting when Supervisor Williams will have the ordinances written. Supervisor Williams seconded and the motion carried. Chairman Schmidt talked to Bob Bell regarding the new library plans. The new plans should be here at the end of this week. Bid forms will be sent with the packet. The Library Board mentioned there should be a specific committee for fundraising for the new library. The only purpose of this committee would be getting donations for the new library. The Library Board has recommended three new Board members: Felicia Gorman, Judy Habermann and Steven Steiner with Amy Balas as an alternate Board member. Supervisor Williams made a motion to appoint Felicia Gorman, Judy Habermann and Steven Steiner to the Library Board with Amy Balas as the alternate Board member effective January 1, 2009. Supervisor Osfar seconded and the motion carried. Discussion held regarding the new patrol truck. The 2009 Budget has been approved by the town’s people in which there was $125,000 in a line item for the new patrol truck. This new truck will replace the 2001 truck that Eric is driving. We received a quote for the truck itself from Peterbilt for $74,000-$76,000. Three quotes were received for the equipment for the truck: Central Wisconsin Body & Hoist, Inc. for $46,366; TEAM Marshfield for $52, 184.79; Monroe Truck Equipment for $53,944. Supervisor Williams made a motion to buy the truck from Peterbilt and the box from Central Wisconsin. Supervisor Osfar seconded and the motion carried. Chairman Schmidt stated the delivery on the truck will be around May 2009. Supervisor Osfar stated the buoys for Papoose Lake have been approved by the DNR. We need to have a Public Hearing to hear comments regarding the buoys. Chairman Schmidt made a motion to have a Public Hearing for discussion regarding the new slow-no-wake buoys on Papoose Lake on January 14, 2009 at 9:00 AM with a Special Town Board Meeting to immediately follow to act on the buoys. Supervisor Osfar seconded and the motion carried.Chairman Schmidt spoke with Jim Janet, Deputy Zoning Administrator, and he has no application or sanitary permit for Joseph Jackowski who is requesting a trailer permit from the Town of Winchester. Mr. Jackowski would like to place a 30 foot travel trailer on his property located North _ of lot 42, Block 10 in the Turtle Lake Resort Subdivision “D”, located in Section 32, Township 44 North, Range 5 East. His lot is 50 feet by 100 feet. We approve trailer permits based on either the sanitary has been installed or there is permitting for sanitary and that he will be getting Vilas County Zoning Permits. Supervisor Williams made a motion to table this until January 2009 to find out what he has done as far as sanitary and contacting Vilas County; has he had it surveyed to know where his lot is and does he know where the access is. Supervisor Osfar seconded and the motion carried.The discussion on the cold mix asphalt treatment will be done at the January 2009 meeting because Scott was not able to make this meeting tonight. Supervisor Osfar made a motion to approve the Operator’s License for Melanie M. Stein. Supervisor Williams seconded and the motion carried.Chairman Schmidt received a letter from Craig VanArk asking the town to explore any options for public access from West Rock Lake Road to North Turtle Lake. Snowmobilers have been crossing his property between his house and woodshed and crossing over the septic area. It is a nuisance to him and dangerous for the snowmobilers. Several other town’s people have had the same problem. They signed the area and that took care of the problem. The Snowmobile Club will provide a sign stating “no snowmobiling”. The town will not do anything because of the liability. Supervisor Williams made a motion that the Town of Winchester not sanction or provide snowmobile access on or off lakes because of liability involved. Supervisor Osfar seconded and the motion carried. Supervisor Williams, aye; Supervisor Osfar, aye; Chairman Schmidt, opposed. Chairman Schmidt made a motion to adjourn to public participation items in compliance with the open meeting law; all comments must pertain to agenda items of what the Chairman considers town business. Supervisor Osfar seconded and the motion carried.Chairman Schmidt made a motion to reconvene into open session. Supervisor Osfar seconded and the motion carried.Chairman Schmidt made a motion to approve vouchers #21287 through #21348 for a total of $86,504.61. Supervisor Osfar seconded and the motion carried.Chairman Schmidt made a motion to go into closed session under SS19.85© considering employment, promotion, compensation or performance valuation of any public employee. Supervisor Williams seconded and the motion carried. Supervisor Osfar, aye; Supervisor Williams, aye; Chairman Schmidt, aye. Those attending closed session are Supervisor Osfar, Supervisor Williams, Chairman Schmidt and Clerk Allis.Chairman Schmidt made a motion to reconvene into open session. Supervisor Osfar seconded and the motion carried. During closed session discussion was held regarding the evaluation of two town employees and the raises they will be receiving. Chairman Schmidt made a motion to raise Joe Moll’s hourly rate to $21.10 effective January 1, 2009. Supervisor Williams seconded and the motion carried. Chairman Schmidt made a motion to raise Eric Turner’s hourly rate to $18.20 effective January 1, 2009. Supervisor Williams seconded and the motion carried. Chairman Schmidt made a motion to raise Beverly Jackson’s hourly rate to $11.50 effective January 1, 2009. Supervisor Osfar seconded and the motion carried.
