February 2, 2009 Town Board Meeting
Minutes of the February 2, 2009 Monthly Town Board MeetingChairman Schmidt called the meeting to order at 7:03 PM. Those attending were Chairman Schmidt, Supervisor Williams, Supervisor Osfar, Clerk Allis and Treasurer Sell. There were 14 people in the audience. Supervisor Williams made a motion to approve the agenda at the discretion of the Chairman. Supervisor Osfar seconded and the motion carried.Supervisor Osfar made a motion to approve the minutes of the January 5, 2009 Monthly Town Board Meeting, January 14, 2009 Public Hearing and January 14, 2009 Special Town Board Meeting. Supervisor Williams seconded and the motion carried.Supervisor Osfar made a motion to accept the Treasurer’s report as read. Supervisor Williams seconded and the motion carried.Supervisor Osfar reported the Town Lakes Committee will be meeting to discuss the grants for the Harris Lake monitoring of invasive species. He stated the DNR has set aside $10,000 for the monitoring. The DNR will be doing a full grid study of Harris Lake and the consulting group will be doing a point intercept study for invasive species. Supervisor Williams reported the Library Board met January 24, 2009. The board approved three workshops for the librarian. The World Champion Musky Classic Board met January 28, 2009. They will be interviewing for scholarships; the scholarships are due the beginning of March. Chairman Schmidt reported the town crew this past month has been doing plowing and routine vehicle maintenance. The new library plans are out; eight contractors have requested plans. Chairman Schmidt has had a number of phone calls for the two pieces of property on County Road O that we have advertised. He hasn’t heard anything for the truck bid. The Emergency Services Board met January 10, 2009. The rescue sled and the rescue vehicle are here and have been used. They discussed new tires for some of the Fire Department equipment. The Fire Department had three trainings this past month – two monthly trainings and a cold water rescue training. There was only one snowmobile rescue last month. Scott Sturgeon, from Scott Construction, gave a presentation on the Wedge and Seal application. This application is used for road surface that is out of shape due to wheel rutting, inverted crown or just bad spots. It consists of spot wedging or thin cold mix overlays using a paver on the existing road surface to bring it back to a smooth surface that will also provide adequate drainage. After the road has been wedged, a seal coat surface will be placed to provide a good bond and wearing surface for the road. Scott Construction has been using this method for over 30 years. It is cost effective and restores pavement life for extended years of service. The Town Board had a discussion with Scott on this process.Chairman Schmidt discussed the Library Fundraising Committee. The Library Board met on January 10, 2009. Their recommendation is a seven member committee – chairperson, Library Board member (Steve Steiner volunteered), Town Board member, Friends of the Library member and three community members. The Library Board discussed a list of twelve names they thought would be good candidates. The Library Board has asked Chairman Schmidt to be the Chairman of the committee. Supervisor Williams suggested the individuals named for the committee, be contacted by letter to see who is interested. Supervisor Osfar didn’t feel the Town Board needed to have a member on the committee since we do have a liaison, Supervisor Williams, who attends the Library Board meetings. Supervisor Williams discussed speed limits/ordinance. He has a new list of 23 roads that could use speed limits. It is the intent of the law that in areas where businesses and residences are closely spaced, within 150 feet of each other, the speed limit can be lowered by the town to 35 MPH and no lower. As it is now, the speed limit is 55 MPH which, for most of our roads, is unattainable. Supervisor Williams has mapped out roads that are good candidates that can go to 35 MPH and also marked places where the speed limit signs are to be placed. Supervisor Williams feels the roads will be safer if they are posted. Supervisor Williams has an ordinance written. Chairman Schmidt made a motion that we table any further discussion regarding the speed limits until the ordinance that has been written by Supervisor Williams has been approved by Vilas County Corporate Counsel, Vilas County Sheriff’s Department, Vilas County District Attorney, our Town’s attorney and the attorneys for the Wisconsin Department of Transportation. Supervisor Osfar suggested posting the 35 MPH yellow caution signs instead of the white signs; he felt this way people would be alerted to the need to slow down. Supervisor Osfar would like to have a friendly amendment to the motion that Supervisor Williams talk to the Town’s attorney to get his opinion on this. Chairman Schmidt added in the friendly amendment to the motion that Supervisor Williams will go first to the Town’s attorney and if the Town’s attorney says that we need to take this ordinance to the Sheriff’s Department, DA, Corporate Counsel and DOT that Supervisor Williams needs to take it to those entities and get approval from them. Supervisor Williams stated he would take it to the Town’s attorney and if he says it is unworkable, then there is no sense of going on. If he tells Supervisor Williams he can proceed with this, then he will come back and decide where to go based on his opinion. Chairman Schmidt restated his motion - Chairman Schmidt made a motion that Supervisor Williams sends a copy of his proposed ordinance to our Town’s attorney, Tim Volke, for his approval and guidance. Supervisor Williams will report back on it at the March Monthly Town Board Meeting. Supervisor Williams seconded and the motion carried.Supervisor Williams reported there were no new road/lane names.Chairman Schmidt made a motion to adjourn to public participation items in compliance with the open meeting law; all comments must pertain to agenda items of what the Chairman considers town business. Supervisor Williams seconded and the motion carried.Chairman Schmidt made a motion to reconvene into open session for approval of vouchers. Supervisor Osfar seconded and the motion carried.Chairman Schmidt made a motion to approve vouchers #21431 through #21500 for a total of $598,799.46. Supervisor Williams seconded and the motion carried.Chairman Schmidt made a motion to go into closed session under SS19.85 © considering employment, promotion, compensation or performance valuation of any public employee. Supervisor Williams seconded and the motion carried. Roll call vote – Supervisor Osfar, aye; Supervisor Williams, aye; Chairman Schmidt, aye. Also going into closed session is Town Clerk, Ruth Allis.Chairman Schmidt made a motion to reconvene into open session. Supervisor Williams seconded and the motion carried. During closed session discussion was held regarding the evaluation of the Fire Chief and Ambulance Director. The Town Board will be sitting down with the Fire Chief, Assistant Chief and John Melzer. The Board will discuss with the three individuals where the department is at, where the department wants to go and how to get there. The Board also reviewed the Ambulance Director’s evaluation. Chairman Schmidt will sit down with the Ambulance Director and go through the evaluation and the same criteria, where the department is at, where the department wants to go and how to get there.
