Minutes of the January 16, 2012 Special Town Board Meeting


Chairman Williams called the meeting to order at 1:00 PM. Those attending were Chairman Williams, Supervisor Misiak, Supervisor Clem and Clerk Allis. There were six people in attendance.

Supervisor Misiak made a motion to approve the agenda at the discretion of the Chairman. Supervisor Clem seconded and the motion carried.

Discussion/possible action regarding town employee – Chairman Williams stated he would like to hold the meeting in open session unless there is an objection to this. No objections were noted.

Chairman Williams asked if Ginger Brousil would like to make a statement to the Town Board at this time. She had no statement to give.

Supervisor Misiak read a summary of events and recommendation to the Town Board pertaining to Ginger Brousil as Recycling Attendant:
On December 7, 2009 as part of her performance review Ginger was given the following directions:
“The town desires that Ginger always represent the town positively and professionally and give our residents and vacationers the best possible impression. Additionally, the Town Board desires that the transfer site be maintained as neat and clean as possible.”

In the 24 months since December of ’09 Ginger has been counseled or reprimanded five times by two Town Boards regarding poor housekeeping and maintenance, failure to follow instructions and failure to follow the work rules and guidelines in her job description.

When I last reminded Ginger that this is the 5th time she has refused to follow the direction of the Board about housekeeping and maintenance she angrily replied “that’s right, it’s a dump!”

When I challenged her about maintenance of the facility she replied “that’s not my job!” even though maintenance is clearly part of her job description. She also said “I am a female, this is harassment, I’m done talking, you can talk to my lawyer.”

At our meeting two weeks ago, Ginger again told us that it’s not her job to represent the town and she is tired of being asked to do so.

During this entire period, Ginger has never told the Board that she will try to improve or that she will try to do a better job or that she will follow the work rules and guidelines. Rather in words and actions, she has told the Board that she will follow the rules that she likes and ignore those that she dislikes.

This Board has been extremely patient but after five unsuccessful attempts to improve the situation, with great disappointment I recommend that Ginger be terminated and that the town immediately post the position for a replacement.

Supervisor Clem asked Ginger if she called the police on Supervisor Misiak after the last conversation Ginger had with Supervisor Misiak. He asked if she felt that threatened? Ginger replied yes. He also asked her about her time card. When he was at the Recycling Center waiting for Ginger to open, Ginger got there at 8:55 AM, but on her time card she wrote 8:45 AM. She stated sometimes she doesn’t leave the Recycling Center until 4:10 PM and she doesn’t write it on her time card, she writes 4:00 PM. Supervisor Clem stated the transfer site has come a long way since 3-4 years ago. Changes have been made and everyone is told to call the Town Board before the Board has a chance to see if the change works. He stated he has a problem with it being a mess all the time. The rumors being told about the Town Board posted on Facebook, everyone has the right of freedom of speech, but you are responsible for what post on the site.

Chairman Williams went over the Town of Winchester Transfer Site Attendant Work Guidelines dated November 1, 2007, and signed by Ginger Brousil and the Town Board at that time. He was pertaining to Section 7, regarding the attendant keeping a daily log of users of the transfer site, what is brought in, users not known to the attendant, unusual materials and quantities brought in, the responsibilities of the attendant to the cleanliness of the building, reporting problems, etc. He also stated Section 11, the Town Board reserves the right to dismiss the attendant if these guidelines are broken. The attendant has the right to be present; Section 14, the attendant will insure that all persons using the transfer site are residents or property owners in the Town of Winchester. Chairman Williams stated he sees Ginger as upset at the town and Board and seems to push off her responsibilities to others. On December 18, 2011 when Chairman Williams went to the transfer site, it was dirty, the toilet wasn’t working (the tank was full and the alarm was turned off), the forklift was out in the trailer (supposed to be kept in the building), cardboard baler was full and two piles of approximately three feet waiting to be baled. There was a note from Ginger telling Don Melzer to bale the cardboard and sweep.

Supervisor Misiak made a motion that Ginger Brousil be terminated and that the town immediately post the position for a replacement. Chairman Williams seconded and the motion carried. Chairman Williams, aye; Supervisor Misiak, aye; Supervisor Clem, aye.

Chairman Williams requested Ginger Brousil return her keys to the transfer station.

Chairman Williams made a motion to adjourn. Supervisor Misiak seconded and the motion carried. The meeting adjourned at 11:11 PM.
