Minutes of the January 20, 2010 Special Town Board Meeting


Chairman Sturgeon called the meeting to order at 9:37 AM. Those attending were Chairman Sturgeon, Supervisor Osfar, Supervisor Misiak and Clerk Allis. There were 8 people in the audience.

Supervisor Osfar made a motion to approve the agenda at the discretion of the Chairman. Supervisor Misiak seconded and the motion carried.

The Town Board listened to comments from the audience regarding the agenda items.

Supervisor Misiak attended the Landfill Venture Group meeting last week. The Highway G Landfill Commission is applying for federal stimulus funds for current and future planned expansion projects. The commission needs to complete the application by the end of January or risk losing the opportunity for the funds. Their legal counsel has advised if some obsolete language were removed from The Intergovernmental Cooperation Agreement between the towns and the landfill group, the application process could be expedited. The town budgets will benefit if the application is approved and their legal counsel advises there are no adverse consequences for the towns. There is a paragraph in the agreement that says if the County applies for the funding each of the municipalities needs to issue a general obligation security bond. According to the legal counsel this is obsolete language that has never been used and is not necessary. It was put in the agreement at the request of the lenders 15-20 years ago. In terms of the current request for federal funds it is not required that the municipalities do anything. The attorney has suggested that the language be removed and made optional in the agreement so the process can be expedited. Because it is a contract between the municipalities and the county, each municipality must sign off on the language change. The language change is basically that the agreement be amended to eliminate the requirement that member municipalities issue general obligation securities in the event of commission borrowing. They have rewritten the agreement requesting a general obligation security from the municipalities shall be optional and only required if need necessary by the Landfill Group. We are asked to approve the changes and sign two documents, the resolution to amend the Intergovernmental Cooperation Agreement and the amendment. Supervisor Misiak made a motion that we, the Town Board, sign the resolution to amend the Intergovernmental Cooperation Agreement and sign the amendment for the Highway G Landfill. Supervisor Osfar seconded and the motion carried.

Discussion held regarding the advisory letter survey to be sent to all the taxpayers regarding 1) repair and upgrading existing library, 2) pay for shared services with neighboring community, 3) build a new library, or 4) other. Supervisor Misiak started a survey letter and this was discussed by the Board. Chairman Sturgeon stated he thought the letter needed to be more specific on the cost of a new library. Supervisor Misiak stated he also thought the costs the Town Board has are outdated and too conservative. Supervisor Osfar stated the bid from Decker was $294,700 for the library, $14,900 for cabinets, $58,000 for furnishings and $50,000 for structural amendments which totals approximately $420,000. Supervisor Misiak read the letter to the audience that the Board will be revising. Chairman Sturgeon suggested the Board obtain a new quote on the cost of a new library and also obtain an estimate for repairing the Community Building. Supervisor Misiak suggested the Board get a better estimate of a potential new library and modify the language to reflect that the project is going to be rebid. Supervisor Misiak also brought up the grant process; it could be months or longer before we actually know whether or not we might receive a grant. The Board is also waiting for Rick Clem’s report on the Community Building in regard to repairs needed. Supervisor Misiak stated the Board will modify the draft letter based on comments today.

Chairman Sturgeon discussed the advisory referendum motion for the new library. He spoke with the Wisconsin Towns Association attorney regarding the legalities of rescinding a motion. Chairman Sturgeon stated if an advisory letter survey is sent out to the taxpayers, why have an advisory referendum vote. The WTA attorney stated you can rescind a motion. Chairman Sturgeon would like to have this on the agenda for the next Town Board meeting. Supervisor Osfar made a motion to put discussion/possible action regarding the motion made for an advisory referendum on building a new library on the next monthly meeting agenda. Chairman Sturgeon seconded and the motion carried.

Comments were heard from the audience regarding the agenda items.

Supervisor Osfar made a motion to adjourn. Supervisor Misiak seconded and the motion carried. The meeting adjourned at 10:30 AM.
