March 2, 2009 Town Board Meeting

Minutes of the March 2, 2009 Monthly Town Board MeetingChairman Schmidt called the meeting to order at 7:00 PM. Those attending were Chairman Schmidt, Supervisor Williams, Supervisor Osfar, Clerk Allis and Treasurer Sell. There were 27 people in the audience.Supervisor Williams made a motion to approve the agenda at the discretion of the Chairman. Supervisor Osfar seconded and the motion carried.Supervisor Osfar made a motion to approve the minutes of the February 2, 2009 Monthly Town Board Meeting. Supervisor Williams seconded and the motion carried.Supervisor Osfar made a motion to approve the minutes of the February 17, 2009 Special Town Board Meeting. Chairman Schmidt seconded and the motion carried.Supervisor Osfar made a motion to approve the Treasurer’s report as read. Supervisor Williams seconded and the motion carried.Supervisor Osfar reported he has been working on a grant for the development of the park to make it accessible. The grant application must be submitted by May 1, 2009. The areas being looked at are between the pavilion and grill, possibly paving that area and putting a roof over it, and landscaping. Supervisor Osfar will have more information at our next meeting.Supervisor Williams reported the Library Board met February 28, 2009. The library received the Vilas County Grant for $2,800.00. The summer hours for the library (June through August) will be extended to: Monday 9:00 AM to 7:00 PM, Thursday 9:00 AM to 7:00 PM and Saturday 9:00 AM to 2:00 PM. The Board also discussed adding links to the town web page. The Library Annual Report has been filed with the town.Chairman Schmidt reported the Emergency Service Board will meet Saturday, March 21, 2009 at 9:00 AM. The Fire Department and Rescue Department had three meetings last month. On Tuesday, February 10, 2009, they went over the off-road rescue procedures and the standard operating procedures for heavy duty rescue. They discussed the Corned Beef and Cabbage Dinner. The department had two other trainings in conjunction with Presque Isle. The trainings in vehicle extrication were put on by Nicolet College. Supervisor Williams seconded and the motion carried.Chairman Schmidt made a motion to table any further discussion regarding the library bids until the March 3, 2009 Special Town Board Meeting at 2:00 PM. Supervisor Williams seconded and the motion carried.The town received one bid for the 2002 Peterbilt 330 patrol truck. The bid was from the Town of Cassian for $43,503.00. They would like delivery on or before May 1, 2009. Supervisor Osfar made a motion to accept the bid from the Town of Cassian for $43,503.00. Supervisor Williams seconded and the motion carried. One bid was received for the purchase of two parcels in the Town of Winchester: Parcel A: NW _ NW _ S 27 T 44N R5E Tax ID #28-1273 34.4 acres Minimum bid $64,500.00 Parcel B: SW _ NW _ S 27 T 44N R5E Tax ID #28-1274 40 acres Minimum bid $75,000.00The bid received from Lenelle Scholl for both parcels is $145,009.00. Supervisor Osfar made a motion to accept the bid from Lenelle Scholl for $145,009.00 with the closing on or about April 15, 2009. Supervisor Williams seconded and the motion carried.Supervisor Williams had not received any road/lane name changes.Supervisor Williams wrote to the town’s attorney, Tim Volke, regarding speed limits/ordinance and received a reply. The attorney would write the ordinance for the town if the town decides to go with the white speed limit signs. Chairman Schmidt is not in favor of the speed limit signs. He has some concerns regarding some of the roads in the town on where the signs will be displayed. Supervisor Osfar recommended to go with the yellow speed limit signs (caution) instead of the white speed limit signs. Supervisor Williams stated the whole intent of the law is to make the roads safer. Chairman Schmidt made a motion that the town table any action on enforceable speed limits for 18 months and during that time put up the yellow caution signs for speed limits. Have a meeting setup for early May and put the signs up June 1st and see how that works. That would give this summer and next winter to see how the caution signs work and after this coming winter 2009-2010 if we still see problems we can revisit the ordinance. Chairman Schmidt amended his motion, instead of 18 months from now, revisit for enforceable speed limits at the September 2010 meeting. Supervisor Osfar seconded the motion and the motion carried. Supervisor Osfar, aye; Supervisor Williams, aye; Chairman Schmidt, abstained. Chairman Schmidt reported on the Landfill Venture Group. The group met on February 18, 2009 for the Executive Committee Meeting and the Annual Meeting. At the Annual Meeting the discussion was what are they going to do about the landfill. Phase 3 will be filled as of this summer 2009. If they are going to do Phase 4, the last of the original plan of the Landfill Venture Group, this phase would take them through 2013, depending on volumes. After 2013 they had six options. There was an unanimous vote by the committee to go with option 5, which is to open Phase 4 to go to 2013 and expand the existing site to take them to 2028. There were proposals to close the landfill after Phase 3, after Phase 4 and hauling the waste to Wisconsin Rapids. The cost for hauling would be $128 per ton for garbage where as option 5 was $40 per ton. The permitting and designing for option 5 would cost approximately $640,000. Of that the town’s share is $24,000. This year we paid $6,000 for the study and will be paying $6,000 for the next three years, depending on the town’s equalized value the amount to be paid may go up or down. This means we will have a place to put our garbage for the next 20 years.Discussion/possible action regarding the1-day beer license for the Emergency Services Corned Beef and Cabbage Dinner is not needed because the fundraiser will be held at the Wilderness Bar and Grill on Sunday, March 15, 2009 at 1:00 PM.Supervisor Osfar discussed the town’s lake accesses. He stated he needed to check out the square footage of the accesses and where they sit. He will bring the results back to the Board at the next meeting. Chairman Schmidt stated some of them are being used as property. Supervisor Osfar stated he would like to give the people on each side the option to split it or maybe one person would like to buy it. Chairman Schmidt stated there are several 50 ft. lake accesses spread all over in the Town of Winchester. One is by Supervisor Williams’, part of his cabin is on that area. Supervisor Williams stated that building has been there for over 50 years. Chairman Schmidt stated Supervisor Williams’ well is south of the lake access, and the new well line that was just put in up to Supervisor Williams’ new house goes through the lake access. Chairman Schmidt stated Supervisor Williams crossed a public access with his well line without permission. Chairman Schmidt stated when other people wanted to cross public property with a private utility they came before the Town Board. Supervisor Williams stated it had not occurred to him that he needed town approval and that the well line is 6-8 feet deep. Chairman Schmidt stated Supervisor Williams has set the precedent that if anyone wants to cross town property or a town road they do not have to bring it before the Board, they can just do it. Supervisor Williams stated the 20 ft. access they are talking about was platted as a lake trail 100 years ago. He and his wife own the property on both sides of the access, they abandoned the well and built a new house. They used the well at the cabin. He stated it never occurred to him that he would need Town permission to bury the well line to his new home. Supervisor Williams stated if this is going to be a problem, he would drill a new well and be done with it. Supervisor Osfar made a motion if there is permission that needs to be granted it will be brought up at the next meeting. Supervisor Williams stated to let the motion die. Chairman Schmidt stated because this was using public property for private gain by a Board member the State Ethics Board has asked for information from this meeting. Chairman Schmidt brought this situation to the Town’s attorney, Tim Volke, and Mr. Volke forwarded the information to the Wisconsin Government Accountability Board’s Ethics and Accountability Division. Chairman Schmidt said that Tim Volke could be at the next meeting to discuss this with the Board. Chairman Schmidt made a motion to adjourn to public participation items in compliance with the open meeting law; all comments must pertain to agenda items of what the Chairman considers town business. Supervisor Osfar seconded and the motion carried.Chairman Schmidt made a motion to reconvene into open session. Supervisor Williams seconded and the motion carried. Chairman Schmidt made a motion to approve voucher #21501 through #21573 for a total of $884,833.45. Supervisor Osfar seconded and the motion carried.Chairman Schmidt made a motion to adjourn.
