Minutes of the May 3, 2010 Monthly Town Board Meeting
Chairman Sturgeon called the meeting to order at 7:01 PM. Those attending were Chairman Sturgeon, Supervisor Osfar, Supervisor Misiak, Clerk Allis and Treasurer Sell. There were 30 people in the audience.
Supervisor Osfar made a motion to approve the agenda at the discretion of the Chairman. Supervisor Misiak seconded and the motion carried.
Supervisor Osfar made a motion to approve the minutes of the April 5, 2010 Monthly Town Board Meeting and the April 26, 2010 Special Town Board Meeting. Supervisor Misiak seconded and the motion carried.
Supervisor Osfar made a motion to approve the Treasurer’s report as read. Supervisor Misiak seconded and the motion carried.
Chairman Sturgeon reported the culverts on South Turtle and East Birch have all been changed out. Stumps and rocks have been removed on South Turtle and there are a couple spots left that need to be taken out on East Birch which will be finished this week. There is a culvert to be replaced on North Star; this should be done this week. The town crew has been cutting trees that have fallen on the roads. They put up and took down the voting booths. The park is officially opened; tables are up and tables are also at the boat landings. The tests were completed on the outdoor sprinkler system at the Community Building. The valves need to be removed and the contractor has agreed to make any necessary changes at no charge. The Library Board did not meet last month.
Supervisor Osfar reported he will be ordering wood chips for the park. The docks are in at all the boat landings. The sand in the sandbox at the park will be removed and new sand will be delivered by Bill Sell.
Supervisor Misiak reported the Emergency Service Departments have been quiet. At the Annual Meeting there was a question raised about transporting a victim from an accident scene or call. The information Jay Woolf shared at the meeting was correct. In order for the ambulance to transport, they have to have two EMT’s on board. This is a state law. Also at the Annual Meeting relative to drivers – all the drivers need to have an Emergency Vehicle Drivers Certificate. We are always short of EMT’s – here in Winchester we now have three active EMT’s. We have four area trainees going through the certification classes which will graduate in June. The Fire Department completed their yearly hose testing. The State of Wisconsin recently passed a law named Maintenance of Effort. It requires towns to provide the state with copies of their Emergency Services Operating Budgets. This report has been completed and sent into the State. In April the town completed and submitted its Annual Recycling Report. This report details the amount of tons of material that we recycle and some of our operating expenses. This report is used to determine our share of grant funds for the next recording period. Supervisor Misiak and Chairman Sturgeon attended a workshop on road maintenance in April. The Planning Committee met in April, but they did not have a quorum. They will meet in May.

Discussion on road/land name changes. Supervisor Misiak and Supervisor Osfar are still completing the survey on all the road signs. They hope to complete this in May.
Discussion on roads and maintenance was discussed in Chairman Sturgeon’s monthly report.
Dale White discussed the Manitowish Waters Regional Alternative Transportation Master Plan. He stated a small part of the plan touches Winchester at Haskins Road. Those approving the plan are: North Lakeland School, Boulder Junction, Vilas County Highway Department, Vilas County Forestry Department, Presque Isle, Mercer and Manitowish Waters. The committee is seeking grants and would like a letter of recommendation from the Town of Winchester. This would not cost the town any money; it’s the school’s project.
Bids for the gravel crushing were opened:
1) Bracket & Sons $3.19/cu yd
2) Meverden Materials, Inc. $3.18/cu yd
3) Pitlik & Wick $2.90/cu yd
Supervisor Osfar made a motion to accept the bid of Pitlik & Wick for $2.90 per cubic yard. Supervisor Misiak seconded and the motion carried.
Bids for scrap metal removal were opened:
1) Ray Straubel – 20-30 yard dumpster, haul away when needed, no charge, except $10.00 for each Freon removal
2) Wheel Haul It – 10 yard dumpster, no charge
3) Brian Backlund – trailer for metals, on call for any pick-up from property owners; reimburse town with 5% of monies from scrap metal
4) Eagle Waste – 30 yard dumpster @ $60.00 per month, plus $250.00 per pick-up
Supervisor Misiak made a motion to accept the bid from Ray Straubel for scrap metal removal. Supervisor Osfar seconded and the motion carried.
Bids for collection and removal of televisions and computer monitors opened:
1) Wheel Haul It – 8 yard dumpster, $200.00 each removal
2) Continental Computer Recycling – bid does not apply
3) Eagle Waste – 15 yard roll-off box; transportation charge $140.00 per haul, plus $30.00 per month and $0.15 per pound
Supervisor Misiak made a motion to accept the bid from Wheel Haul It for removal of monitors and televisions. Supervisor Osfar seconded and the motion carried.
Bids for repair of existing foundation of Community Building opened:
1) Lassig Bros. Construction Co., Inc. - $34,711.00
2) Oneida General Contractors - $19,881.00
3) John’s Service - $20,282.50
4) Stag Enterprise - $17,300.00 (option #1); $11,500.00 (option #2)
5) Reuss Construction Co. - $77,270.00 (option #1); $59,762.00 (option #2)
Supervisor Misiak made a motion to table any decision regarding the foundation bids until a future meeting after the Board further reviews the bids. Supervisor Osfar seconded and the motion carried.
Chairman Sturgeon received a letter from Gary Ruschmeyer stating a public nuisance complaint regarding the building next to the Bear Bar. One concern was the outer walk way roof which once connected the two main buildings is collapsing; another concern is one of the buildings is partially collapsed and the other building is about ready to collapse. Also, there are hazardous and flammable substances in one of the buildings. Chairman Sturgeon stated the Public Nuisance Ordinance 2005-01 states the Town Chairman shall inspect the property and write a report as to his findings in regards to the complaint. The report will be sent by registered mail to the property owner and person filing the complaint. If the condition exists that is in violation of the ordinance, the property owner will have 30 days from the time of the report to correct the violation. Supervisor Misiak stated the owner needs to make appropriate improvements and repairs to be approved by the Town Board. Supervisor Osfar made a motion to give the owner 60 days to complete the work as described by the Town Board with the assistance of our Fire Inspector, Bill Sell. Also, attach a copy of the Town of Winchester Public Nuisance Ordinance. Supervisor Misiak seconded and the motion carried.
Fire Chief, Bill Sell, stated the Town of Winchester Emergency Response Plan needs to be updated and kept on file. Jim Galloway, Vilas County, can make the updates for the town since he has the plan on his computer. Bill Sell recommends this plan to be adopted by the Town Board for the Town of Winchester. Supervisor Misiak made a motion to adopt the Town of Winchester Emergency Response Plan with clerical changes endorsed by Fire Chief Bill Sell. Supervisor Osfar seconded and the motion carried.
Rick Clem and Rolf Ethun, Lions Club members, discussed the refreshment building to be built at the town park. The cost will be approximately $28,000.00. The club does not want to cut corners because it will be an asset to the community. The price is more than the Lions Club anticipated. They would like to get the refreshment building finished by July 4th so the Chamber can use it for the Picnic in the Park. The Lions Club is asking the town to contribute $8,000.00 towards the building. Supervisor Misiak made a motion to contribute $8,000.00 towards the Lions Club $28,000.00 facility at the park. Supervisor Osfar seconded and the motion carried.
Chairman Sturgeon stated we will need to have some gravel hauled this summer. He stated the town can have someone haul the gravel without putting out bids as long as the price is $5,000.00 or less.
Supervisor Osfar made a motion, should the need arise, to approve the hauling of gravel from the town pit up to $5,000.00. Supervisor Misiak seconded and the motion carried.
Chairman Sturgeon stated is will cost $700.00 for someone to come and inspect the Community Building for asbestos. Supervisor Osfar made a motion to approve the $700.00 for the inspection of the Community Building for asbestos. Supervisor Misiak seconded and the motion carried.
Supervisor Osfar made a motion to adjourn to public participation items in compliance with the open meeting law; all comments must pertain to agenda items of what the Chairman considers town business. Supervisor Misiak seconded and the motion carried.
Supervisor Osfar made a motion to reconvene into open session. Supervisor Misiak seconded and the motion carried.
Chairman Sturgeon made a motion to approve vouchers #22405 through #22471 for a total of $46,663.49. Supervisor Misiak seconded and the motion carried.
Chairman Sturgeon made a motion to adjourn. Supervisor Misiak seconded and the motion carried. The meeting adjourned at 8:43 PM.
