Minutes of the May 3, 2010 Special Town Board Meeting
Chairman Sturgeon called the meeting to order at 9:30 AM. Those attending were Chairman Sturgeon, Supervisor Osfar, Supervisor Misiak, Clerk Allis, Keith Kost, Steven Garbowicz and Eric Turner.
Supervisor Misiak made a motion to approve the agenda at the discretion of the Chairman. Supervisor Osfar seconded and the motion carried.
Keith Kost, Attorney for the Town of Winchester, stated the meeting today involves a possible action against a town employee. Chairman Sturgeon provided to Eric Turner a listing of what went wrong. Under the policy the employee has the right to address any of the issues. Steven Garbowicz, Attorney for Eric Turner, stated he only received the list five minutes ago and was not prepared to respond to the list.
Keith Kost asked Chairman Sturgeon if he wanted to call for a motion to see what the town wants to do.
Keith stated if there is a motion made and a second then we will ask Eric if he wants to address anything at that time. Chairman Sturgeon made a motion to terminate Eric Turner’s position on the town. Attorney Garbowicz stated just so I’m clear, the reasons are what you stated you gave to me five minutes ago. Chairman Sturgeon stated this isn’t just from the last six months, this is from a long period of time. The list is only what has happened in the last six months. Supervisor Misiak seconded the motion. Mr. Kost asked Steven Garbowicz if either he or Eric would like to respond before the Town Board discusses the motion or would you like to respond after the discussion? Mr. Garbowicz stated if he would have received the list a week ago he would have had time to respond today and would have had witnesses come in to testify about what was transpired here. Given that I got this five minutes ago, I don’t know how I could respond to this. Eric Turner did not wish to respond. The Town Board had a discussion before they had a vote.
Supervisor Misiak stated he has three years of history from Eric’s file – Rob Schmidt’s performance reviews for 2007 and 2008, and this Town Board’s review in 2009. The same issues occurred in all performances – attendance, attitude, speech, action, completing work on time, job dependability and judgment. Six months ago the Board went over the same material with Eric. We indicated to Eric three years was long enough and a repeat of this behavior is unacceptable.
Supervisor Osfar agreed with Supervisor Misiak. He stated Eric was given a number of opportunities to “square away” and it has been real difficult for him to do that. Many times when you work for someone things may not be the way it should be, but if there are problems you bring it up to the people you work with. When you start talking down about your employer, it is not contagious for a good atmosphere or for the town’s people. Eric could have held himself in a more professional manner.
Chairman Sturgeon stated Eric has had six months to improve and he hasn’t done much on that. Eric has no one to blame but himself. At your last evaluation, most of your problems come from your drinking and you agreed. I wish you would have done something about it. The last thing I want to see is anyone lose their job, especially you have a family. That’s probably why you have been on this job as long as you have. I hope you can get your life back together and get some help.
Before the vote, Mr. Kost asked if Mr. Garbowicz’s client wanted to address anything. Mr. Garbowicz stated he wanted a copy of this tape and the minutes.
Chairman Sturgeon stated there is a motion on the floor which was seconded. All in favor, Supervisor Osfar, aye; Supervisor Misiak, aye; Chairman Sturgeon, aye. The motion carried unanimously.
Chairman Sturgeon asked Eric Turner to turn in his keys. All Eric’s personal belongings he has at the town garage and/or in his town truck will be given back to him. It was decided to have Joe Moll, town crew member, retrieve the belongings for Eric.
Supervisor Osfar made a motion to adjourn. Supervisor Misiak seconded and the motion carried.
The meeting adjourned at 9:42 AM.
