Minutes of the November 7, 2011 Monthly Town Board Meeting


Chairman Williams called the meeting to order at 7:00 PM. Those attending were Chairman Williams, Supervisor Clem, Supervisor Misiak, Clerk Allis and Treasurer Sell. There were 19 people in the audience.

Supervisor Clem made a motion to approve the agenda at the discretion of the Chairman. Supervisor Misiak seconded and the motion carried.

Supervisor Misiak made a motion to approve the minutes of the October 3, 2011 Monthly Town Board Meeting, October 11, 2011 Special Town Board Meeting, October 26, 2011 Special Town Board Meeting and November 4, 2011 Special Town Board Meeting. Supervisor Clem seconded and the motion carried.

Supervisor Clem made a motion to accept the Treasurer’s report as read. Supervisor Misiak seconded and the motion carried.

Supervisor Clem reported the town has received the checks from the Harris Lake Association for the AIS grant they received from the DNR. The Harris Lake Association has not received information regarding the 2012 grant for AIS from the DNR. The Plan Commission continues to review the town ordinances. The Lakes Committee will not meet until January 2012. The Historical Committee is in the process of putting together a notice for bids for work to be done to the interior of the library. The landscaping at the Community Building is completed. This was paid for from a donation Marge Engel received. Paul Coan will be doing the overhang for the Community Building. The town crew will be placing the handicap handrail in the rest room at the Community Building.

Supervisor Misiak reported his items are on tonight’s agenda. He reported the Winchester Fire and Rescue Departments are having a fundraiser, Spaghetti Dinner, November 19, 2011, from 4:30 – 8:00 PM at the Municipal Building.

Chairman Williams reported the Library Board met. The internet speed at the library is quite slow so they will check into another provider. Chairman Williams thanked Paul Coan for reattaching the stone on the outside of the Municipal Building and did not charge the town for his work. Don Melzer has been staining the trim on the Municipal Building and he sealed the compactor at the Transfer Station which was leaking. Bill Johnson will be replacing the concrete slab outside the Town Hall, if the weather holds this week. He will slope it away from the building so it will be easier to get in and out with a wheel chair. The town crew has been brushing, putting up road signs, hauling sand for the roads for this winter, shouldering, maintaining equipment, graveling, and today cutting trees that had fallen with yesterday’s wind. Jim Cayo took the ambulance to the Kemper Auto Body to have the headlights adjusted and fix the back door. They did not charge the town for this.

Supervisor Clem gave the board members a copy of the updated Light Ordinance. He suggested the Town’s attorney look over the ordinance with the updates. Supervisor Clem made a motion to send the updated Light Ordinance to the Town’s attorney for review. Chairman Williams seconded and the motion carried.

Supervisor Clem made a motion to table any action regarding the Nuisance Ordinance for one month. Chairman Williams seconded and the motion carried.

Chairman Williams stated John Dougherty called him today and he has been ill and not able to complete the work on his building. He stated he is going to try to get the building closed up by the end of this week. Chairman Williams made a motion to table any action regarding the Dougherty property. Supervisor Clem seconded and the motion carried.

Supervisor Clem reported Mud Lake Road needs to be put on the Five Year Plan because of the P.I. Peddlers wanting to put up bike trail signs. Supervisor Clem made a motion that the Plan Commission put Mud Lake Road in the Five Year Plan. Supervisor Misiak seconded and the motion carried.

Supervisor Misiak stated the EMS/Fire Department has a number of expenditures that they would like to make. Supervisor Misiak made a motion to approve these expenditures. They are: 1) Darley pump, $9,500; 2) two portable lights, $2,900; 3) sign in front of the Municipal Building that identifies the Fire Department and Ambulance Department, $3,000; 4) Ambulance Dept. purchase cold weather gear, $1500. These expenditures are planned items within their 2011 budget. The Ambulance Department has agreed to share some of these expenses with the Fire Department. Chairman Williams questioned what kind of sign would be placed in front of the Municipal Building. Supervisor Misiak showed a picture of the sign. Ginger Brousil stated it would be the same as the other wooden town signage.
Supervisor Clem seconded the motion and the motion carried.

Chairman Williams discussed the Amendment #2 Intergovernmental Cooperation Agreement. He stated this is an amendment to the agreement to use the Highway G Landfill in Eagle River. Chairman Williams read the amendment. He stated they want to accept waste from other communities outside of Vilas County. Two years ago we were required to put money into developing a new and final pit. Chairman Williams recommended the Board to not sign this agreement. Supervisor Misiak stated the Highway G Landfill is trying to remain competitive and they are trying to meet their operating costs. People in Vilas County can go somewhere else if they can get a better rate. He stated the various landfills within and outside the county compete for waste. The landfill must meet a certain tonnage to meet their operating costs. They strongly recommended that we approve this amendment so that they can manage their operating costs. If they can’t meet their operating costs, they would have to increase the cost to their communities that are participating within Vilas County. Supervisor Misiak attended the meeting two months ago and the argument was pretty significant that this was a net gain for Vilas County. We could share the overhead of that facility with surrounding communities and help manage the operating cost which will have to be paid for by the communities that do participate should they have a short fall. Chairman Williams stated he is concerned that once the new pit, the last that can be put on that sight, is filled up, they will have to find a new landfill. Supervisor Clem asked how many boards were at the landfill meeting? Supervisor Misiak stated about a dozen were there and they all voted for the amendment. Supervisor Misiak made a motion to approve Amendment #2 of the Intergovernmental Cooperation Agreement to allow the Highway G Landfill to accept users outside of Vilas County. Supervisor Clem seconded and the motion carried; Supervisor Misiak aye, Supervisor Clem aye, Chairman Williams opposed.

Supervisor Misiak made a motion to approve the Short Term Tax Collector Bond for the Town Treasurer, Geri Sell. Supervisor Clem seconded and the motion carried.

Chairman Williams discussed having automatic thermostats that will reset it self in the library and community room of the Community Building. This way when the community room or library are in use, the thermostat can be changed and later it will automatically reset to the original setting. Chairman Williams stated since this is a commercial building it needs to be installed by a licensed contractor. Chairman Williams made a motion to have two setback thermostats installed in the Community Building. Supervisor Clem seconded and the motion carried.

Supervisor Misiak made a motion to approve a Temporary Class “B”/”Class B” Retailer’s License for the Fire Department, Joan Wainio, for the Spaghetti Dinner, November 19, 2011 at the Municipal Building. Supervisor Clem seconded and the motion carried.

Chairman Williams made a motion to adjourn to public participation items in compliance with the open meeting law; all comments must pertain to agenda items of what the Chairman considers town business. Supervisor Misiak seconded and the motion carried.

Chairman Williams made a motion to reconvene into open session. Supervisor Clem seconded and the motion carried.

Supervisor Misiak made a motion to approve vouchers #23516 through #23582 for a total of $60,312.57. Supervisor Clem seconded and the motion carried.

Chairman Williams made a motion to go into closed session under SS19.85© considering employment, promotion, compensation or performance valuation of any public employee. Supervisor Clem seconded and the motion carried. Roll call vote: Chairman Williams, aye; Supervisor Misiak, aye; Supervisor Clem, aye. Those attending closed session are Chairman Williams, Supervisor Misiak, Supervisor Clem, Clerk Allis, Ginger Brousil and Sulo Wainio.

Supervisor Misiak made a motion to reconvene into open session. Supervisor Clem seconded and the motion carried.

Chairman Williams stated in closed session discussion was held regarding billing and the Ambulance Department expense policy. Supervisor Misiak stated he will draft an expense policy highlighting expenses are to be reported in an expeditious manner.

Supervisor Misiak made a motion that he will draft an expense policy. Supervisor Clem seconded and the motion carried.

Supervisor Clem made a motion to adjourn. Chairman Williams seconded and the motion carried. The meeting adjourned at 8:09 PM.
