Minutes of the October 28, 2009 Special Town Board Meeting
Chairman Sturgeon called the meeting to order at 9:33 AM. Those attending were Chairman Sturgeon, Supervisor Osfar, Supervisor Misiak and Clerk Allis.
Supervisor Osfar made a motion to approve the agenda at the discretion of the Chairman. Supervisor Misiak seconded and the motion carried.
Supervisor Misiak made a motion to go into closed session under SS19.85© considering employment, promotion, compensation or performance valuation of any public employee. Supervisor Osfar seconded and the motion carried. Roll call vote – Chairman Sturgeon, aye; Supervisor Osfar, aye; Supervisor Misiak, aye. Those going into closed session are Chairman Sturgeon, Supervisor Osfar, Supervisor Misiak and Clerk Allis.
Supervisor Misiak made a motion to reconvene into open session. Supervisor Osfar seconded and the motion carried. In closed session discussion was held regarding the Town Crew’s performance and evaluation.
Discussion was held with Eric Turner regarding his performance and evaluation. It was brought to Eric’s attention that overtime is paid for all hours over 40 hours per week. The Town Board also discussed with Eric the amount of time off he has taken. They went over the “Town of Winchester Personnel Policy for the Town Crew” regarding section 3 (E) – scheduling of vacation time will be at the discretion of the Town Board supervisor in charge of the employee , and section 5 (B) – the second time a work rule is broken, a written reprimand will be issued and the employee will lose days of pay. Chairman Sturgeon made a motion to suspend Eric Turner for the rest of today, October 28, 2009, and tomorrow, October 29, 2009, without pay and return back to work Friday, October 30, 2009. Supervisor Osfar seconded and the motion carried.
The Town Board discussed with Eric Turner his evaluation. Supervisor Misiak made two recommendations – 1) that there be no raise based on performance during this performance review and 2) the Board is willing to reconsider a pay review in six months. Supervisor Misiak made it clear to Eric Turner how serious this matter is, the next step will be potential cause for termination. The Town Board would like to see Eric continue as a town employee, but the Board also feels this discipline policy is appropriate and we are at step three – potential termination. Supervisor Misiak made a motion to hold any pay raise for Eric Turner for six months and re-evaluate in six months (May 2010) and if improvement is seen, the Board will consider giving Eric Turner a raise in pay. Supervisor Osfar seconded and the motion carried.
The Town Board discussed with Joe Moll his evaluation. Supervisor Misiak made a motion to give Joe Moll a 3% raise in pay starting January 1, 2010. Supervisor Osfar seconded and the motion carried.
Discussion held regarding which roads to repair in 2010. Chairman Sturgeon stated the prevailing wage starts January 1, 2010 and will result in at least 15% increase for road work. If the town can get bids before January 1, 2010 and accept the bid, the town can bypass the prevailing wage for 2010. The roads that need work are: South Turtle, East Birch Lake, Keppler and Island View. After much discussion, Supervisor Misiak made a motion to get bids on South Turtle Lake Road and East Birch Lake Road. Supervisor Osfar seconded and the motion carried.
Supervisor Misiak made a motion to adjourn. Supervisor Osfar seconded and the motion carried. The meeting adjourned at 10:47 AM.
